Official Rules
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. Sweepstakes is open only to legal residents of the 50 United States, including the District of Columbia; and Canada, excluding Quebec, age 18 or older and of legal age of majority in their state or province of residence. Do not enter if you are not currently located in one of the 50 United States, D.C or Canada. Void in Quebec, Puerto Rico and where prohibited by law. Sweepstakes begins at 12:00:01 AM Central Time (“CT”), June 15, 2008 and ends at 11:59:59 PM CT, September 30, 2008. (“Promotional Period”). Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.
How to Enter: To enter: Visit www.seeyouontheporch.com during the Promotion Period and follow the online instructions to complete the online entry form (first name, last name, email address and phone number) and upload a photograph or video. Photo submitted online must be in .jpg format and may not exceed 2 MB in size. Video submitted must be in .avi, .mov or .wmv format. Guests who consume a stay at a participating Country Inn & Suites By Carlson® location during the Promotional Period may visit www.seeyouontheporch.com, and follow the online instructions to enter your first name, last name, email address, phone number and reservation confirmation number. To enter for free by mail send a 3”x5” card with name, phone number, complete mailing address, email address and mail in a business size envelope to: Country Inns & Suites See You On the Porch Sweepstakes, P.O. Box 626, Becker, MN 55308, to be postmarked by October 1, 2008 and received by October 6, 2008.
No mechanically reproduced entries permitted. Illegible or incomplete entries are void. Released Parties (as defined below) are not responsible for any expenses incurred in the production or submission of any photographs or videos or for lost, late, damaged, delayed, mutilated, postage due, misdirected entries or entries not received by entry deadline. Limit one original video or photo entry per person/email address/mailing address per day, regardless of method of entry. Neither Sponsor, nor its respective affiliates or subsidiaries or their respective officers, directors, employees or agents are responsible for: (1) interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software or telephone transmissions or technical failures, Internet Service Provider/network/website accessibility or availability, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic; including without limitation the incomplete, incorrect or inaccurate capture of entry information; or (2) any injury or damage to persons or property which may be caused directly or indirectly in whole or in part, from entrant’s participation in the sweepstakes or receipt or misuse of any prize. Sponsor reserves the right, in its sole discretion, to disqualify any individual found tampering (or attempting to tamper) with the entry process, the website, or the Sweepstakes. Any attempt by an entrant to deliberately damage the website or undermine the legitimate operation of the Sweepstakes is in violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such entrant to the fullest extent permitted by law, including criminal prosecution. In case of dispute as to identity of entrant, entry will be declared made by the authorized account subscriber of the email account, who must comply with these Official Rules. Sponsor reserves the right, at its sole discretion, to cancel/suspend/modify the online portion of the Sweepstakes, if it becomes corrupted in any manner, or due to fraud or other occurrences beyond Sponsor's control it cannot be conducted as originally planned. By submitting a photo or video, each entrant represents that the photo or video submitted has never been published.
Each entrant further represents that use thereof does not infringe third party rights (including those of any photographer/videographer), is suitable for publication in a public forum (as determined by Sponsor in its sole discretion), may not contain nudity, profanity, or threats of physical violence, and may not reflect negatively on us or our services and that each photo or video is free of any and all liens, encumbrances and claims of third parties. Each entrant acknowledges, agrees and warrants that nothing in the photograph or video infringes on any copyrights, confidential information, trade secrets, trademarks or other intellectual property rights belonging to any person or entity other than the entrant, or defames, disparages or violates any person’s, living or deceased, rights of privacy, publicity or other property rights, and that all necessary releases and permissions, for purposes of entry and as specified in these Official Rules, have been secured by entrant from contributors and, in the case of legal minors, their respective parents/guardians and entrant agrees to provide reasonable documentation supporting the foregoing, at Sponsor’s discretion, upon request. Entries not complying with all rules are subject to disqualification at Sponsor's sole discretion. Photos and videos submitted become the exclusive property of Sponsor and will not be returned. With respect to photo and video entered, entrant unconditionally assigns and transfers to Sponsor all rights, title, interest and claims, including, without limitation, the copyright therein. Sponsor shall have right to use, alter, assign or dispose of such entries however it sees fit without approval of entrants. In order to accept the prize, except where prohibited, entrant will be required to grant the Sponsor the right to use entrant's name, image, personal information, likeness and biographical materials, as well as entrant's Photo or Video submitted, for advertising, publicity and promotion purposes including, without limitation, online announcements without additional compensation, unless prohibited by law.
Drawing: Four Monthly drawings – one (1) winner will be randomly selected for each month of the Promotional Period. Each monthly drawing will include all eligible entries received through all entry methods as of 11:59:59 pm CT on the last day of the applicable month, combined during the entry period for that month and non-winning entries from any previous months, as non-winning monthly entries will be rolled over into subsequent monthly drawings. Each monthly drawing will occur on or about the 7th day of the following month. The Official Judging organization, whose decisions are final and binding in all matters relating to the Sweepstakes, will conduct the drawings. By participating, entrants agree to abide by and be bound by these Official Rules and the Administrator’s decisions. Winners will be notified by regular mail, email and or phone. Odds of winning depend on the number of eligible entries received for each drawing. Prize winners will be required to sign and return an Affidavit/Declaration of Eligibility and a Publicity Release (where legal), within 10 days of prize notification or prize will be forfeited. If any prize or prize notification is returned as undeliverable, such prize will be forfeited. Sponsor reserves the right, at its sole discretion, to cancel/suspend/modify the Sweepstakes if it becomes corrupted in any manner such that it cannot be conducted as originally planned and, in such event, to select winners by random drawing from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. If Canadian resident is selected as a potential winner they will be required to correctly answer, without the assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question.
Prizes/Approximate Retail Value (ARV): Monthly prize (1 per month for 4 months): A 4-day/3-night hotel stay for winner and three (3) family members at a participating Country Inn & Suites location in the continental US. or Canada, subject to availability. Trip includes 3 night’s hotel accommodations (one room, quad occupancy), 4-day standard car rental for a full-size car from Thrifty Car Rental and a $100 debit card that can be used for gas. All unspecified travel-related expenses, including but not limited to airfare, meals, gratuities, ground transportation, any upgrades, and incidental hotel expenses, are the sole responsibility of the winner and his/her guests. ARV: $700 each. (Any difference between stated approximate retail value and actual value of prize will not be awarded.) Hotel stay must occur within one year of prize notification or prize will be forfeited in its entirety. Winner and guests must stay on the same dates. Winner and guests are responsible for obtaining all necessary travel documents. Guests of winner must sign and return a liability release prior to booking hotel. If any guest is a minor, he/she must be accompanied by parent or legal guardian, who must sign and return all required documentation. Winner must comply with the terms and conditions of the Thrifty rental car agreement. Total ARV of all prizes: $2,800. Prize values are in U.S. dollars. No transfer of prizes. No more than the stated number of prizes will be awarded. No substitution of prize or cash redemption, except as provided herein. Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion. Limit one prize per person.
Eligibility Restrictions: Employees, directors and officers of Carlson Hotels Worldwide Inc., Gage Marketing LLC, and each of their respective parent companies, affiliates, subsidiaries or any of their agents, advertising, promotional and other agencies, and their immediate families (parents, siblings, children and their respective spouses) and persons living in the same household (whether related or not) are not eligible to enter the Sweepstakes or win a prize. By participating and/or accepting a prize, entrants/winners release and agree to defend, indemnify and hold harmless Sponsor, Gage Marketing LLC, and each of their respective parent companies, subsidiaries, affiliates and the directors, officers, employees and agencies of any of the above entities (“Released Parties”) from any liability whatsoever for any injuries, losses, costs, expenses, or damages of any kind (including without limitation, all direct, indirect, incidental, special, punitive, exemplary, or consequential claims, losses or damages, including lost revenues, profits or good will, all penalties, and all attorney’s fees, disbursements and costs of suit) resulting from acceptance, possession or use/misuse of any prize or participation in the Sweepstakes and any travel related thereto.
Except where prohibited by law, entrants/winners agree that under no circumstances will any entrant/winner be permitted to obtain awards for, and entrants/winners waive all rights to claim, attorney’s fees, and indirect, punitive, incidental, special, exemplary, and consequential damages and any other damages (other than actual out-of-pocket expenses), and any and all rights to have damages multiplied or otherwise increased.
Except where prohibited by law, by accepting a prize, winner agrees that Sponsor and its affiliated companies may use the winner’s name, address (city, state/province), photograph, videotape, likeness, and/or prize information for advertising, publicity and promotional purposes and to the use of statements made by or attributed to winner relating to Sponsor or to this Sweepstakes and grants to Sponsor any and all rights to said use without further notice and/or compensation except where prohibited by law. Any expenses, including any applicable tax on the prize, are solely the responsibility of winner.
Privacy: Except as otherwise set forth herein, information entrants provide to Sponsor will be used to communicate with entrants regarding this Sweepstakes and otherwise as set forth in the Sponsor’s Privacy Policy available at www.countryinns.com.
By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Minnesota, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Minneapolis, Minnesota.
